Protecting the digital archives
of Claude users
We defend the right to receive and keep a complete archive of all work with Claude — including AI responses and reworked internet materials — even after an account block.
01 · CORE POSITION
Ownership of the archive copy
The user must hold ownership of a full copy of the information, including AI responses and reworked internet materials, and the right to obtain it regardless of an account block.
- Information ownership — the user must have their own copy of the entire history of work with Claude;
- Copyright — receiving a copy of the archive does not transfer copyright over third-party materials;
- Like a purchased book — the buyer owns the copy of the book; the author's rights to the text remain.
02 · WHAT A COMPLETE DIGITAL ARCHIVE INCLUDES
- User prompts — entered texts and tasks;
- Claude responses;
- Conversation history — the order of chats, dates and links;
- Documents and attachments — uploaded and created files;
- Project code and materials;
- Internet materials — quotes and reworked texts.
03 · CONTRACTUAL RIGHTS
- The user retains their rights to prompts; Anthropic transfers its possible rights to responses subject to conditions;
- Export after a block is provided for, but its scope may be limited;
- Section 202 of US law separates ownership of the material copy from copyright.
04 · CLAIMS
- Primary — receive the entire archive: hand over all surviving materials in a readable form, list the missing parts and the reasons for exclusions;
- Separately — refund the payment for the unused period (a refund does not replace the archive);
- On evidence — compensation for losses, subject to contractual liability limits.
05 · WHO MAY NEED PROTECTION
- Individual users — paid or free account;
- Organisations and entrepreneurs — the archive owner or an authorised representative applies.
06 · WHAT TO RECORD
- Account: owner, authority, countries, plan;
- Access restriction: date, notice, reason, contract terms;
- The archive and its contents: what is missing, what copies survive;
- Request and response: date of the full export request, the reply;
- Payments and losses: payments, recovery expenses.
07 · PREPARATION ORDER
- Legal position → complaint form → similar cases → lawyer assessment → choice of procedure;
- Before filing we identify the defendant and the court, verify dispute procedures, deadlines, costs, and the possibility of collective proceedings;
- Submitting a complaint does not mean joining a case or entering an agreement with a lawyer.
Tell us what happened — we are preparing the legal position and the intake procedure for a possible class action.
